These Terms and Conditions set out the basis on which Rubbish Removal Lewisham provides waste collection and related services to residential and commercial customers. By making a booking, you agree that these Terms and Conditions form the entire agreement between you and Rubbish Removal Lewisham for the provision of the services.
1. Definitions
In these Terms and Conditions, the following expressions shall have the meanings set out below:
Customer means the individual, business or organisation requesting the services from Rubbish Removal Lewisham.
Services means any rubbish removal, waste collection, clearance, loading, transportation, disposal, recycling, or related services provided by Rubbish Removal Lewisham.
Booking means a confirmed request for services made by the customer by telephone, email, online form or any other accepted method of communication.
Waste means any items, materials or substances that the customer asks Rubbish Removal Lewisham to remove, transport or dispose of.
Contract means the legally binding agreement between Rubbish Removal Lewisham and the customer formed in accordance with these Terms and Conditions.
2. Service Area
Rubbish Removal Lewisham provides rubbish removal and waste collection services primarily within Lewisham and surrounding areas. Acceptance of any booking is subject to confirmation that the service address is within an area that can be reasonably served. Rubbish Removal Lewisham reserves the right to decline bookings outside its usual operating area or to apply additional charges where travel distance or access conditions require it.
3. Booking Process
3.1 Customers may request a quotation and make a booking by telephone, email or online. When making a booking, the customer must provide accurate information about the type and approximate volume of waste, the location, access arrangements, and any relevant restrictions such as parking or time limits.
3.2 Any quotation provided before waste is inspected is an estimate only and may be subject to change once the team arrives on site and assesses the actual volume, weight, type and handling requirements of the waste.
3.3 A booking is not confirmed until Rubbish Removal Lewisham has accepted it and provided a booking confirmation, which may be given verbally, by email or by message. Rubbish Removal Lewisham reserves the right to refuse any booking at its discretion.
3.4 The customer is responsible for ensuring that the contact details and service address supplied at the time of booking are correct. Rubbish Removal Lewisham will not be liable for delays or additional costs arising from inaccurate or incomplete information supplied by the customer.
4. Customer Responsibilities
4.1 The customer must ensure that access to the collection point is safe, lawful and free from obstruction at the agreed time of service. This includes arranging suitable parking or access for the collection vehicle, where required.
4.2 The customer must ensure that any waste to be collected is clearly identified and separated where necessary. If the customer is not present, clear instructions must be provided in advance about the items to be removed. Rubbish Removal Lewisham will not be liable for removing items that reasonably appeared to be waste based on the instructions given.
4.3 The customer is responsible for securing any necessary permissions from property owners, landlords, managing agents, neighbours or local authorities for the collection, loading and removal of waste from the premises.
4.4 The customer must inform Rubbish Removal Lewisham in advance of any hazardous, restricted or unusual waste, or of any special handling requirements. Additional charges or refusal of service may apply in such circumstances.
5. Service Delivery
5.1 Rubbish Removal Lewisham will use reasonable endeavours to attend the customer’s premises at the agreed date and time or within any indicated time window. All attendance times are estimates and are not guaranteed, and may be affected by traffic, access, weather, or operational issues.
5.2 If Rubbish Removal Lewisham is delayed or unable to attend at the agreed time, reasonable efforts will be made to notify the customer and to agree an alternative time. Rubbish Removal Lewisham will not be liable for any indirect or consequential loss arising from any delay or rescheduling.
5.3 Upon arrival, the team will assess the waste and confirm the final price based on the actual volume, weight, type and loading requirements. If the customer does not agree to the revised price, Rubbish Removal Lewisham may cancel the service and no further obligation shall arise, subject to any applicable call-out or minimum charge that has been clearly communicated.
5.4 Rubbish Removal Lewisham reserves the right to refuse to remove any waste that is unsafe to handle, not as described at the time of booking, unlawful to transport, or not in compliance with applicable waste regulations.
6. Pricing and Payments
6.1 Prices are typically based on factors including but not limited to the volume of waste, type of material, weight, labour required, access conditions and disposal or recycling costs. Any price information given in advance of inspection is indicative and not binding until confirmed on site.
6.2 All prices are quoted in pounds sterling and may be subject to VAT where applicable. Any call-out, congestion, parking or additional access charges will be advised as soon as reasonably practicable.
6.3 Unless otherwise agreed in writing, payment is due in full upon completion of the service, and must be made by an accepted method such as cash, card payment or bank transfer. For business customers with agreed credit terms, payment shall be made within the period specified on the invoice.
6.4 Rubbish Removal Lewisham reserves the right to charge interest on overdue invoices at the statutory rate, together with any reasonable costs incurred in recovering late payments.
6.5 Where payment details are provided in advance, the customer authorises Rubbish Removal Lewisham to take payment for the agreed amount on completion of the service and for any agreed additional charges arising from changes to the service on the day.
7. Cancellations and Amendments
7.1 The customer may cancel or amend a booking by contacting Rubbish Removal Lewisham by telephone or email. Cancellations or amendments are not effective until acknowledged.
7.2 If the customer cancels a booking with less than 24 hours notice before the agreed arrival time, Rubbish Removal Lewisham reserves the right to apply a cancellation charge, especially where a vehicle and crew have been allocated.
7.3 If the customer fails to provide access to the premises at the agreed time, or if the waste is not available for collection as described, this may be treated as a late cancellation and a call-out or cancellation fee may be charged.
7.4 Rubbish Removal Lewisham may cancel or reschedule the service at any time for operational reasons, safety concerns, adverse weather, vehicle breakdown, staff illness or other circumstances beyond its reasonable control. In such cases, any deposits paid for the cancelled service will be refunded or applied to a rescheduled service, and no further liability shall arise.
8. Waste Regulations and Restricted Materials
8.1 Rubbish Removal Lewisham operates in accordance with applicable UK waste management legislation and guidance, including obligations relating to the transport, handling and disposal of controlled waste. Waste will be taken only to licensed disposal or recycling facilities, and appropriate records may be retained as required by law.
8.2 The customer confirms that they have the right to arrange for the removal of the waste and that the waste is not stolen, unlawfully obtained or in breach of any third-party rights.
8.3 Certain types of waste are restricted, hazardous or subject to specific regulatory controls. These may include but are not limited to asbestos, chemicals, solvents, medical or clinical waste, gas bottles, oils, fuels, batteries, contaminated soils, and electrical or electronic equipment requiring special treatment.
8.4 The customer must inform Rubbish Removal Lewisham in advance if any such materials are present. Rubbish Removal Lewisham may decline to handle certain materials or may agree to handle them subject to special arrangements and additional charges.
8.5 If restricted or hazardous waste is discovered during the service that was not disclosed at the time of booking, Rubbish Removal Lewisham may refuse to collect it, adjust the price, or terminate the service. The customer may be liable for any additional costs, losses or regulatory consequences arising from the presence of undisclosed restricted waste.
9. Title to Waste
9.1 Title and responsibility for the waste passes from the customer to Rubbish Removal Lewisham at the point when the waste is loaded onto the collection vehicle, provided that the waste is lawful and within the scope of the agreed service.
9.2 Once the waste has been collected, Rubbish Removal Lewisham will be responsible for transporting, processing, recycling or disposing of it in accordance with applicable regulations and industry practice.
10. Liability and Damage
10.1 Rubbish Removal Lewisham will exercise reasonable care and skill when providing the services. However, the customer accepts that minor scuffs, marks or cosmetic damage may occur during the removal of bulky or heavy items from confined spaces, stairwells or areas with restricted access.
10.2 The customer should move or protect any fragile items, floor coverings, decorations, fixtures or fittings that could be damaged during the service. Rubbish Removal Lewisham will not be liable for damage to items that the customer has failed to protect where such damage could reasonably be anticipated.
10.3 Rubbish Removal Lewisham shall not be liable for any indirect, consequential or economic loss, including loss of profits, revenue, opportunity or goodwill, arising from or in connection with the services, whether in contract, tort or otherwise.
10.4 Nothing in these Terms and Conditions limits or excludes liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot lawfully be excluded under UK law.
10.5 Subject to the above, the total liability of Rubbish Removal Lewisham for any claim arising out of or in connection with the services shall be limited to the total price paid or payable by the customer for the specific service giving rise to the claim.
11. Complaints
11.1 If the customer has any concerns or complaints about the service, they should notify Rubbish Removal Lewisham as soon as possible, giving full details of the issue, the date of service and supporting information where available.
11.2 Rubbish Removal Lewisham will investigate reasonable complaints and will seek to resolve them promptly, which may include offering a remedy where appropriate. Any complaint relating to alleged damage or loss must be reported within a reasonable time after the service, and in any event no later than 7 days following completion.
12. Data Protection and Privacy
12.1 Rubbish Removal Lewisham may collect and process personal data relating to customers for the purposes of managing bookings, providing services, handling payments, and complying with legal obligations.
12.2 Personal information will be handled in accordance with applicable UK data protection laws. Information will not be sold to third parties and will only be shared where necessary to deliver the services, process payments, or meet legal or regulatory requirements.
13. Force Majeure
13.1 Rubbish Removal Lewisham shall not be in breach of contract nor liable for any delay in performing, or failure to perform, any of its obligations where such delay or failure results from events, circumstances or causes beyond its reasonable control. These may include, but are not limited to, extreme weather, acts of God, strikes, lockouts, accidents, road closures, traffic incidents, or disruption to utilities.
14. Variation of Terms
14.1 Rubbish Removal Lewisham may update or amend these Terms and Conditions from time to time. The version in force at the time of the customer’s booking will apply to that specific service. Customers are encouraged to review the current terms when arranging new services.
15. Governing Law and Jurisdiction
15.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or with the services, shall be governed by and construed in accordance with the laws of England and Wales.
15.2 The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the services provided by Rubbish Removal Lewisham.
16. Entire Agreement
16.1 These Terms and Conditions constitute the entire agreement between the customer and Rubbish Removal Lewisham in relation to the provision of rubbish removal and waste collection services. No other statement, representation or assurance shall form part of the contract unless expressly agreed in writing.
By making a booking with Rubbish Removal Lewisham, the customer confirms that they have read, understood and agree to be bound by these Terms and Conditions.
